Cloudflare, Inc. (“Cloudflare”) is pleased to have a forum available for Cloudflare user support (the “Community Website”), hosted by Civilized Discourse Construction Kit, Inc. (“CDCK”). The Community Website is governed by the CDCK terms of service (https://meta.discourse.org/tos) and privacy policy (https://meta.discourse.org/privacy), each as they may be modified from time to time, in addition to the Community Website Terms of Service set forth below, as they may be amended from time to time (the “CWTOS”):

Please read this Agreement carefully before accessing or using the Community Website. By accessing or using any part of the Community Website, you agree to become bound by the terms and conditions of this CWTOS. If you do not agree to all the terms and conditions of this CWTOS, then you may not access or use any portion of the Community Website. If these terms and conditions are considered an offer by Cloudflare, acceptance is expressly limited to these terms.

  1. Agreement not to Sue; Limitation of Liability—By agreeing to this CWTOS you agree (a) not to sue Cloudflare or any of its employees, directors or affiliates in connection with the Community Website or any content, acts or omissions by you or any other person or entity arising from content on, or use of, the Support Forum and (b) that neither Cloudflare nor any of its employees, directors or affiliates will be liable to you for any claims or damages related to content on, or use of, the Community Website in any way, including but not limited to, incidental, consequential or special damages.

  2. Third Party Proprietary Information; Open Source Code—You agree not to post any confidential, trade secret or proprietary information of any third party on the Community Website regardless of whether you have the right to use such information. Notwithstanding the foregoing, you may post open source code or links to open source code to the extent permitted by the owner of such open source code.

  3. User Content License—User contributions are licensed pursuant to the CDCK terms of service; provided, however, that Cloudflare reserves the right (but not the obligation) to: (i) refuse or remove any content on the Community Website, or (ii) terminate or deny access to and use of the Community Website to any individual or entity for any reason, at Cloudflare’s discretion.

  4. Responsibility of Community Website Visitors—Cloudflare has not reviewed, and cannot review, all of the material, including computer software, posted to the Community Website, and cannot therefore be responsible for that material’s content, use or effects. By sponsoring the Community Website, Cloudflare does not represent or imply that it endorses the material posted on it, or that it believes such material to be accurate, useful or non-harmful. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. The Community Website may contain content that is offensive, indecent, or otherwise objectionable, as well as content containing technical inaccuracies, typographical mistakes, and other errors. The Community Website may also contain material that violates the privacy or publicity rights, or infringes the intellectual property and other proprietary rights, of third parties, or the downloading, copying or use of which is subject to additional terms and conditions, stated or unstated. Cloudflare disclaims any responsibility for any harm resulting from the use of any content on the Community Website.

  5. Content Posted on Other Websites—Cloudflare has not reviewed, and cannot review, all of the material, including computer software, made available through the websites and webpages to which discourse.org links, and that link to discourse.org. Cloudflare does not have any control over any of those websites or webpages, and is not responsible for their contents or their use. Any linking to another website or webpage on the Community Website does not represent or imply that Cloudflare endorses such website or webpage. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content.

  6. Changes—Cloudflare reserves the right, at its sole discretion, to modify or replace any part of this CWTOS. It is your responsibility to check this CWTOS periodically for changes. Your continued use of or access to the Community Website following the posting of any changes to this CWTOS constitutes acceptance of those changes.

  7. Termination—All provisions of this CWTOS survive termination of the CWTOS.

  8. Disclaimer of Warranties—The Community Website is provided “as is” to visitors. Cloudflare hereby disclaims all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement.

  9. Indemnification—You agree to indemnify and hold harmless Cloudflare, its employees, directors and affiliates from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Community Website, including but not limited to your violation of this CWTOS.

  10. Miscellaneous—This CWTOS, together with the CDCK terms of service and privacy policy, constitute the entire agreement between you and Cloudflare concerning the subject matter hereof, and they may only be modified by a written amendment signed by an authorized executive of Cloudflare. You hereby agree that any access to or use of the Community Website will be governed by the laws of the state of California, excluding its conflict of law provisions, and the proper venue for any disputes arising out of or relating to any of the same will be the state and federal courts located in San Francisco County, California.
